La richiesta di C.T.U. tecnica formulata dalla parte può essere rigettata dal giudice in ragione della documentazione già presente in atti, comprensiva anche della C.T. effettuata in sede di procedimento di mediazione.

Sempre più giudici stanno affermando il principio che una consulenza tecnica svolta nel corso di un procedimento di mediazione civile possa essere utilizzata anche in seno al giudizio.
Anche l’ordinanza sopra citata emessa dal Tribunale di Roma segue tale orientamento.
Tuttavia, non è ancora acclarato se la consulenza tecnica svolta nel corso della mediazione (ctm) possa svolgersi o meno nel contraddittorio tra le parti.
Alcuni organismi di mediazione, nei loro regolamenti, consentono l’espletamento della ctm anche in assenza della controparte.
